The Information We Collect/or Receive; the Purpose of Collection and Use

In the course of operating the Website and/or interacting with you, we will collect (and/or receive) the following types of information.

Contact and Personal Information

When you sign up to receive any of our emails or free Content, respond to a survey, register for a class, course, webinar, or program, book a call with us, purchase any product or service, or sign up to become our affiliate partner, you may be required to provide us with certain information about yourself, such as your name, postal address, e-mail address, social media information, phone number, PayPal address (only if you sign up to become our affiliate partner) and Social Security number/Tax ID number (only if you sign up to become our affiliate partner) (the “Contact Information”). The Contact Information is used to provide the requested product or service or information and to contact you for purposes of direct marketing of our current and future products and services. When you book a call with us, we may also require and/or ask you to provide us with additional personal information about yourself (such as your age, goals for the call, etc.) that will help us determine if we are a good fit for you and how to best serve you during the call.

Order Information

When you place an Order, you must provide us with certain information about the products and services you are seeking to purchase. Such information is collectively called the “Order Information.” The Order Information is used to fulfill your Order.

Billing Information

When you wish to purchase a product or service, you will be required to provide certain information in addition to the Contact and Personal Information and Order Information noted above. Such information may include a debit card number, credit card number, expiration date, billing address, activation codes, bank account and routing number, and similar information. Such information is collectively called the “Billing Information.” Billing Information is collected and processed by our third-party payment processor operating as our agent (see, Onward Transfers to Third Parties). We do not directly obtain or process any Billing Information.

Information Collected in Private Training, Consulting, and Coaching Sessions

If there is a conflict between provisions of this section and other sections within this Agreement, this section is controlling.

The private training, consulting, and coaching communications shared between only you and us during the term of that service that you purchased and made under this Agreement is collected to better serve you in our coaching role. Such private communications will not be intentionally disclosed by us with certain limitations and exceptions as follows:

1. The Trainer-Consultant-Coach/Client relationship between you and us is not a legally confidential relationship, such as with medical, mental health, and legal professionals, and has no legally recognized privilege; 2. We will disclose any client information required by statute (e.g., child and elder abuse), applicable rules of professional conduct, applicable codes of professional responsibility, a lawfully issued subpoena, or by a court or lawful order to disclose; 3. We may, in our sole discretion, or if legally required to, disclose information of your intent to commit a crime or the commission of a crime; to prevent reasonably certain death or substantial bodily harm; and, to establish a claim or defense on behalf of us, in a controversy with or involving you or based upon our services with you; 4. We may, in our sole discretion, disclose any of your feedback, comments, statements, reviews, or testimonials related to us or our services, at any time during or after the term of the coaching services, without notifying you. We will refrain from using your name or any of your identifying information if you ask us in writing not to do so.

You understand and agree that we cannot and do not guarantee confidentiality of any kind. If we plan to audio or video record a private session, we will let you know at the beginning of the session.

You understand and agree that the use of technology is not always secure and accept that your sensitive and private information and communications may be accessed, copied, used, transmitted, or disclosed by third parties through our or your use of email, text, phone, video conferencing services, computer, web, or software programs and applications, and any other technology.

You understand and agree that we, and our officers, directors, managers, members, employees, agents, volunteers, and representatives are not responsible for any disclosures of your sensitive and private information and communications, including, but not limited to, disclosures that may occur through or as a result of an accident or oversight, any third party actions, hacking, deception, theft, burglary, invasion of privacy, or any criminal, unforeseen, or random occurrence, or disclosures that may occur through or as a result of an unsecured or compromised phone line or internet connection.

You understand and agree that you are responsible for checking and ensuring that whatever equipment, connection, hardware, software, technology, etc., you use to receive and participate in the coaching services is reasonably and adequately secure.

Information Collected Through Non-Training, Consulting, or Coaching Communications

If there is a conflict between provisions of this section and other sections within this Agreement, this section is controlling.

We collect information about you when you set up and participate in a free call with us and when you communicate with us regarding that call or as a result of that call. Any communications shared between only you and us in that non coaching context is collected to facilitate our conversations with you and to help us determine whether any of our coaching services are appropriate for you. Such private communications are not legally protected, but they will not be intentionally disclosed by us with certain limitations and exceptions as follows:

1. We will disclose any information required by statute (e.g., child and elder abuse), applicable rules of professional conduct, applicable codes of professional responsibility, a lawfully issued subpoena, or by a court or lawful order to disclose; 2. We may, in our sole discretion, or if legally required to, disclose information of your intent to commit a crime or the commission of a crime; to prevent reasonably certain death or substantial bodily harm; and, to establish a claim or defense on behalf of us, in a controversy with or involving you or based upon the coaching services with you; 3. In an ongoing effort to better understand our Visitors, Registered Users, and our products and services, we may analyze the Order Information and Other Information in aggregate form in order to operate, maintain, manage, and improve the Website and/or our products and services. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes.

Sharing with Third Parties

Like many businesses, we contract with other companies to perform certain business-related services. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. Communication Preferences

You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing email. Customers cannot opt out of receiving transactional e-mails related to their account or their Orders. We will use commercially reasonable efforts to process such requests in a timely manner.

Information You Share on Public Forums

We feature or may in the future feature public forums such as message boards or web logs, webinars, classes, telephone conferences, or coaching calls, user comments, chat rooms, and similar activities (collectively, “Public Forums”). You may voluntarily post and share information through such Public Forums. NONE of the information you provide through the Public Forums or through use of these features are protected by this Privacy Policy including any personal information.

How We Protect the Information
